The Guyana Geology and Mines Commission (GGMC) is warning miners and other stakeholders against selling mining lands, cautioning that such transactions may breach the laws governing mining tenure in Guyana.
In an advisory, the Commission said mining lands are granted to individuals and entities specifically for mining activities, subject to applicable laws, regulations and the conditions attached to the relevant tenure.
It also warned against using Irrevocable Powers of Attorney in transactions involving mining properties, stressing that such documents are not, in themselves, proof of ownership or lawful tenure.
Persons seeking to acquire an interest in mining properties are being urged to verify their legal status directly with the GGMC before signing agreements or committing money.
Recognising that some mining properties require additional investment, technical expertise or financial resources to become productive, the Commission is encouraging miners and tenure holders to consider lawful joint venture arrangements with suitable partners.
Such arrangements, it said, can help facilitate the development and productive use of mining properties while ensuring compliance with the law.
The warning comes alongside a reminder that the GGMC will continue compliance and enforcement exercises across all Mining Districts to ensure that mining activities are conducted lawfully.
The Commission said persons found in breach of mining legislation could face enforcement action, including prosecution where warranted. Deportation proceedings will also be pursued against non-nationals where applicable under Guyana's laws.
The GGMC further reminded miners that all gold produced must be sold to the Guyana Gold Board, licensed gold traders or dealers, describing compliance with the requirement as compulsory and necessary to maintain transparency and accountability in the industry.
The Ministry of Natural Resources and the GGMC said they remain committed to safeguarding Guyana's mineral resources, promoting responsible mining and ensuring that the sector operates within the law.
